Can this be notarized online in Texas?
The question is not whether every document can be notarized online in Texas. The question is whether this document can. Some acknowledgments and jurats can be done on a live video session. Some documents still need a visit, because the paper itself has to be signed where I am standing, or because the office that will receive it will not accept an online certificate.
On a remote session we meet live on video. There is no travel fee, and I stay in Texas for the entire session. 1 Texas Administrative Code § 87.41 requires that. You may be elsewhere only when that act is allowed online. You need a private place, a working camera, and a connection that can finish the identity check. The platform checks the photo identification and asks identity questions.
The session is recorded because Texas law requires it. Government Code § 406.108 requires a secure electronic record, and that record includes the video and audio conference. The recording shows the identity check, the identification credential, and the act. You cannot refuse the recording and still finish a remote session. A traditional visit is not recorded. The recording is not the journal, and the electronic record is kept at least five years.
Each online act is the fee in Government Code § 406.024 plus a $25 online notarization fee. An acknowledgment is $10 for the first signature and $1 for each additional signer, and then the $25. An oath or a jurat is $10, and then the $25. An evening or a weekend adds the posted time-of-day amount. The quote does not apply the 15 percent discount for a later appointment.
A vehicle title is a visit unless the office that will accept the title has told you it will take a Texas online certificate. A power of attorney can be online only when the bank, the hospital, or the other party that will rely on it will accept that certificate. I do not control that decision. Ask them before we book the session.
If the act cannot be done online, I will say so. If you are within 60 miles of 3517 78th Drive in Lubbock, we can set a visit instead. I do not travel farther than that. I do not offer a real-estate loan-signing package.
I am not an attorney licensed to practice law in Texas and may not give legal advice or accept fees for legal advice. I do not tell you whether the document should be signed, or whether a court or an agency will accept it.
This note describes how I work. It is not legal advice.
