Agreement
These Terms of Service (“Terms”) govern your use of the Double E's Notary Services website and the notarial services provided by Eric Etheredge, Notary Public, State of Texas, Commission 135560858 (the “Notary,” “I,” “me,” or “we”). By requesting an appointment, using the quote builder, calling or texting (806) 543-3374, emailing eetheredge@att.net, or otherwise engaging services, you agree to these Terms.
If you do not agree, do not request or use the services.
Nature of the services
Double E's Notary Services provides traditional (in-person / mobile) notarial acts and Remote Online Notarization (“RON”) as authorized by Texas law. I am a commissioned Texas Notary Public. I am not an attorney, I do not practice law, and I do not give legal advice, document-drafting advice, immigration advice, or advice about the legal effect of any document.
No attorney-client relationship is created by using this website, requesting a quote, or completing a notarization. If you need legal advice, consult a licensed attorney.
Quotes and fees
The fee schedule published on this website, including the quote builder, is incorporated into these Terms. Notarial-act fees do not exceed the maximums in Texas Government Code § 406.024. The online notarization fee does not exceed the maximum in Texas Government Code § 406.111.
Travel, mileage, scheduling, holiday, weather, location, wait-time, printing, witness, rush, courier, and cancellation fees are separate service charges. Quotes generated on this website are estimates based on the information you enter. The amount due is the itemized total for the services actually performed.
Fees are due at the time of service unless we agree otherwise in writing before the appointment. I may require payment before traveling or before starting a RON session.
Identification and appearance
Every signer must personally appear before me — in person for traditional notarizations, or by simultaneous audio-visual communication for RON — and present satisfactory evidence of identity as required by Texas law. Typically this is an unexpired government-issued photo identification document.
I may refuse to proceed if identification is expired, damaged, inconsistent with the document, or otherwise unsatisfactory; if a signer appears unwilling, disoriented, or under duress; if the document is incomplete in a way that prevents a proper notarial act; or if performing the act would violate Texas law or these Terms.
- I do not certify the truth of the document’s contents, other than as required for a jurat or similar act.
- I do not certify that a document is legally sufficient, recordable, or acceptable to any third party.
- Signers must understand the document they are signing. I cannot explain its legal effect.
Appointments, travel, and cancellations
Traditional appointments are scheduled from 3517 78th Dr, Lubbock, TX 79423 across the Lubbock and the South Plains and surrounding communities, subject to availability, weather, and road conditions. Mileage is measured round trip from that address. The first 10 round-trip miles are included in the posted $25 base travel fee; each additional round-trip mile is $1.
A cancellation or a no-show is $50, or the travel already earned if I am in transit, whichever is greater. If I arrive and the notarization cannot be completed for any reason — including missing identification, an unwilling signer, incomplete documents, or a refused signing — travel fees remain due.
Wait time is $15 for the first 15 minutes and $15 for each additional 15 minutes. There is no unpaid waiting period.
Remote Online Notary
RON is available only when Texas law permits the act to be performed online. I remain physically located in Texas during every online session. You are responsible for a private, well-lit space, a working camera and microphone, a stable internet connection, and a device capable of completing identity proofing.
Online sessions require credential analysis of your identification and knowledge-based authentication (or other identity-proofing methods required by the platform and Texas law). If you cannot complete identity proofing, the session cannot proceed. Platform or connectivity failures are not a waiver of fees already earned for time reserved, though I will make a reasonable effort to reschedule.
Texas law requires an audio-visual recording of each online notarization, so the session is recorded. The receiving party decides whether to accept a Texas online certificate. Recordings and the electronic journal are retained as described in the Privacy Policy.
Documents, printing, and witnesses
You are responsible for providing complete, correct documents. I may print electronic documents for a fee as published. I do not guarantee that a receiving party, county clerk, title company, lender, or court will accept any document.
If a document requires a witness and you have not arranged one, I may provide a witness for the published fee, subject to availability. I do not act as both notary and witness on the same signature.
Prohibited requests
I will not notarize my own signature, a document in which I am a party, or an act that Texas law does not authorize. I will not backdate a notarial certificate, notarize a signature I did not witness as required, certify a copy of a publicly recordable instrument that I am not authorized to certify, or participate in any transaction that appears fraudulent or unlawful.
Website and quote builder
This website is provided for information and appointment requests. The quote builder is a convenience calculator that applies the published fee schedule to the details you enter. The result is a high-end estimate and is not necessarily the amount you will be billed. The invoice is the itemized total for the services actually performed. The quote builder does not reserve an appointment, create a contract for a specific time, or guarantee that a particular act can be performed.
Repeat clients automatically receive a 15% discount on future transactions. The quote builder does not calculate or display that discount.
The site may store a draft quote in your browser’s local storage so you can return to it. You may delete it at any time by clearing site data. Do not submit information about another person unless you have authority to do so.
Limitation of liability
To the fullest extent permitted by Texas law, my liability for any claim arising out of the services or this website is limited to the fees you paid for the specific appointment giving rise to the claim. I am not liable for indirect, incidental, special, or consequential damages, including a third party’s refusal to accept a notarized document, delays by title companies, lenders, courts, or courier services, or losses caused by incomplete or inaccurate information you provided.
Nothing in these Terms limits liability that cannot be limited under Texas law, including liability for my own gross negligence or willful misconduct where such a limitation is prohibited.
Indemnity
You agree to indemnify and hold harmless the Notary from claims arising out of your misuse of the services, inaccurate information you provide, documents you supply, or your violation of these Terms, except to the extent caused by my gross negligence or willful misconduct.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for any dispute lies in the state courts located in Texas. If a provision is held unenforceable, the remaining provisions continue in effect.
Changes and contact
I may update these Terms by posting a revised version on this website with a new “last updated” date. The version in effect when you request the appointment governs that appointment.
